Terms & Conditions (AGB)
Last updated: 7 October 2025
1. Definitions
1. Definitions
- “Course” refers to all online programs, bootcamps, modules, and digital materials provided through the Website.
- “Cohort start date” refers to the date on which your access to the Course begins. The start date is displayed or communicated at the time of purchase.
- “Provider” refers to Sergei Logvinov, the self-employed owner and operator of the Website.
- “Website” refers to sigmus.academy or any affiliated subdomain used to deliver the Course.
2. Scope
These Terms & Conditions govern all purchases and use of online courses, bootcamps, and digital content (“Course”) made available via the Website. By completing a purchase or accessing the Course, you agree to these Terms & Conditions.
3. Course Access and Delivery
- Access is provided digitally through a password-protected platform.
- The Course follows a weekly release (“drip content”) model:
- Access to the first module begins on your cohort start date, as displayed at the moment of purchase.
- Each subsequent module unlocks automatically at weekly intervals from that date.
- The cohort start date forms part of the Course design and may differ between participants or cohorts.
- The delivery schedule is considered part of the agreed service and does not constitute a delay in performance.
- Access credentials are personal and may not be shared with others.
4. Territorial and Customer Scope
The Course is primarily intended for international participants and business clients. We do not market or sell this Course to private consumers (“Verbraucher” as defined in §13 BGB) residing in Germany.
Reason: Under German law (§12 Fernunterrichtsschutzgesetz – FernUSG), distance learning programs offered to consumers in Germany require prior approval by the Zentralstelle für Fernunterricht (ZFU). Since this Course is not ZFU-certified and is designed for professional and international participants, it is not available to private individuals residing in Germany.
By purchasing, you confirm that you are either (a) acting in a business capacity or (b) not a resident of Germany.
5. Access Duration and Refunds
- Unless otherwise stated on the sales page, participants receive access for at least 12 months from their cohort start date.
- After this period, access may be extended or migrated to a new platform at the Provider’s discretion.
- Except as provided under the statutory withdrawal right before access begins, all sales are final.
- Refunds are not provided once access has started, unless required by law or in exceptional cases (e.g., duplicate payment, technical failure).
6. Prices and Payment
- All prices are stated in euros (€).
- Payments are processed securely via third-party providers such as Stripe or PayPal.
- Access to the Course is granted only after full payment is received.
7. Right of Withdrawal (Widerrufsrecht)
For digital content not supplied on a physical medium, your statutory 14-day withdrawal right applies until access to the digital content begins. By purchasing, you acknowledge that:
- Your access begins on the cohort start date, which is communicated at purchase.
- Course modules are delivered progressively over time.
- This constitutes the start of digital content delivery.
You agree that your 14-day withdrawal right expires once access begins. If you cancel before your cohort start date, you are entitled to a full refund by emailing your@email.com.
8. Intellectual Property
All Course materials, including videos, slides, code examples, text, and downloads, are protected by copyright. You receive a personal, non-transferable license to use them for your own educational purposes. Redistribution, resale, recording, or public sharing of Course content or credentials is prohibited.
9. Liability
- The Provider prepares all materials with professional diligence but does not guarantee specific learning or financial outcomes.
- Liability for slight negligence is limited to foreseeable, direct damages arising from essential contractual obligations.
- The Provider is not liable for indirect, consequential, or economic losses, or for service interruptions beyond their control.
10. Technical Requirements
Participants are responsible for maintaining the necessary hardware, internet connection, and software to access the Course. Interruptions caused by third-party service providers (e.g., hosting, payment, or video platforms) are outside the Provider’s responsibility.
11. Data Protection
Personal data is processed according to the Provider’s Privacy Policy. We comply with the EU General Data Protection Regulation (GDPR).
12. Governing Law and Dispute Resolution
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- For business customers, the exclusive place of jurisdiction is Berlin, Germany.
- The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. The Provider is not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
